Brooks County Probate Records

Brooks County Probate Court is a court of record with exclusive jurisdiction over the probate of wills, administration of estates, and appointment of guardians or conservators for incapacitated adults and minor children. It also handles commitments to involuntary evaluation for mental health, drug, or alcohol issues. The court issues marriage and firearms licenses, administers oaths of office, and performs other administrative duties tied to probate court work.

The current Brooks County Probate Judge is Hon. Kathy Shiver, serving since January 1, 2021. The judge is a nonpartisan constitutional officer elected for four-year terms. Probate Court is separate from the Clerk of Superior Court and from Magistrate Court. For probate records tied to estates, wills, guardianships, and conservatorships, start with Probate Court rather than the Superior Court clerk unless a separate Superior Court case exists.

Brooks County Probate Contact

The Brooks County Probate Court is located in the courthouse complex in Quitman. Published hours are Monday through Friday, 8:00 AM to 4:30 PM, with a lunch closure from 12:00 p.m. to 12:30 p.m. The court also posts special counter rules for license work: marriage licenses and weapons carry renewals are completed between 8:00 AM and 4:00 PM, customers need to arrive before 4:00 PM, and no payments are accepted after 4:00 PM.

Probate staff may assist with services and procedure questions, but Georgia law bars staff from giving legal advice, restating the law for a party, or recommending how to pursue legal action. That line matters in estate and guardianship cases because the court can process filings but cannot act as counsel for a petitioner.

The petition process is different from a public record search. A search finds existing information; a petition asks the court to open, administer, or decide a matter. Keep that difference clear when speaking with court staff.

Brooks County Marriage Probate Records

Marriage licenses are a probate-facing record in Brooks County. Applicants may start the application online at the Marriage Application tile, but the Brooks Probate Court marriage-license page says the applicants must visit the office after submission to complete the process. The Probate Court also says marriage licenses are handled during the posted license window, and the office stops accepting payments after 4:00 PM.

Restricted Brooks County Probate Records

Not every Brooks County probate record is open in the same way. Public search access should not be treated as permission to view every filing in the case.

The Probate Court also states that it does not handle traffic, election, vital records, or game/fish law violation cases. Brooks County State Court handles traffic and game/fish law violations. The Brooks County Board of Elections handles elections. Vital records are handled through the Brooks County Health Department. These boundaries prevent a probate search from being used for the wrong record type.
